Ms. Susan Kimani, MIAC Co-Registrar and PCA Legal Counsel

Ms. Susan Kimani is a Co-Registrar of the Mauritius International Arbitration Centre (MIAC), where together with her Co-Registrar, Ms. Ashwita Ambast, she heads the MIAC Secretariat and administers arbitrations, pursuant to the MIAC Arbitration Rules 2018 and other procedural rules.
Ms. Kimani also serves as Legal Counsel at the Permanent Court of Arbitration (PCA). As Legal Counsel, she acts as registrar and tribunal secretary in international arbitrations involving various combinations of states, state entities, international organizations and private parties, including arbitration proceedings under investment laws. She also assists the PCA Secretary-General with appointing authority matters, including challenges, under the UNCITRAL Arbitration Rules and other procedural rules. The PCA is an intergovernmental organization based in The Hague, the Netherlands, with permanent offices in Mauritius and Singapore.

Course synopsis:
The circumstances which may result in a challenge to an arbitrator are increasing. The body of rules and guidelines governing ethics in international arbitration are evolving, but remain largely uncodified. Understanding the key concepts, the process of challenging an arbitrator and the new developments in the field of ethics in international arbitration is essential for every legal practitioner. This course will unpack the dynamic field of ethics in international arbitration and the circumstances that may result in a challenge to an arbitrator using practical examples drawn from cases and scenarios that have arisen in challenge proceedings. The course will address some niche vocabulary, such as “double hatting” and “issue conflict”, as well as emerging ones such as “arbitration couples”.
